On the way to work today I went past a couple of coppers parked up and they pointed something at me as I went past.

They were tucked into a bus stop on the opposite side of the road to me so I didn't really see them until I was almost on top of them and I as there was no traffic coming towards me I was overtaking the car infront. It was doing 35 in a 40 andI would have accelerated up beyond the speed limit to overtake, probably 50-55 although I only glanced at my speed when I saw the coppers. When I looked I was dropping back to 40 from 50.

I know that overtaking is not an excuse for speeding but if they were using a hand held device is that the sort of thing where they would have had to stop me to discuss or can they note my license down and send through a letter within two weeks?

For those who live close by it was on the stretch between West Byfleet and Byfleet just before you go over the M25.

I think a picture showing you, the bike and your speed together with a note of your number plate is sufficient to get a nick. :cry: And yes the 14 day NIP thing will apply.

This is all assuming the thing they pointed at you was a camera.

Andy,.... the Surrey Camera Van is out daily. The van seems to park for about 30 minutes or so,.. then moves and repositions. I usually se it positioned just over 'Crests' or other blind-spots where the road suggests a higher speed than the sped limit allows. The fact that the Police Van was Illegally parked in a Bus Stop, thus creating it's own hazard, ... well.. make your onw mind up. As above,... use the 'Pace' letter if you do get a NIP.

If I'm not mistaken, they have 3 months in which to send out the NIP. They probably wouldn't, but don't think you're in the clear if you haven't heard anything for a couple of weeks. :(

They have 14 days to send out the NIP, if the bike is yours.
Only in the case of company vehicles can it take longer for you to get the NIP, as they are allowed time to find the driver's details.

If you havent received a NIP within 17 days (reasonable time for postage on top of teh 14), then fight it if they try to do you subsequently.

Have helped 5 people on these things so far, including myself.

If they issued the NIP within the 14 days, they then have up to 6 months to prosecute.

It is 14 days for the N.I.P to be sent and they have 6 months to start proceedings not 6 months for a prosecution, unless it is an offence for insurance for which us bad boys get longer.
